Remember what an expert is there to do: explain complex issues to the judge or jury so they can understand, relate to, and accept that opinion. Those requirements will be different if it’s a judge (in a bench trial) or a jury (in a jury trial) – particularly around the issue of relatability. But the key is that the expert is able to have a natural conversation in which they communicate their opinion in a way that is accessible to the audience. And it doesn’t matter if the courtroom is full of people; it doesn’t matter if thirty lawyers attend the deposition. The audience for an expert opinion is the judge or the jury.
